Terms of Service

1. Acceptance of Terms

By accessing and using PlasmaRift's lead generation services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PlasmaRift provides lead generation services that identify and deliver qualified business prospects to our clients. Our services include:

• Lead discovery across multiple advertising channels
• Lead qualification and verification
• Targeted prospect identification
• Multi-channel advertising and outreach

3. Pricing and Payment Terms

Our pricing is performance-based and varies by advertising channel:

• Social Media Leads: $40 per qualified lead
• Search & Display Leads: $50 per qualified lead
• Premium Multi-Channel Leads: $60 per qualified lead

Payment is due within 30 days of invoice date. Late payments may incur additional fees. All prices are in USD and exclude applicable taxes.

4. Lead Quality Standards

We guarantee that all delivered leads meet the qualification criteria agreed upon during service setup. A qualified lead must:

• Match the demographic and geographic criteria specified
• Contain accurate and verified contact information
• Demonstrate genuine interest or intent in your product/service category
• Be obtained through legitimate marketing channels

5. Client Responsibilities

Clients agree to:

• Provide accurate targeting criteria and qualification requirements
• Respond to leads in a timely and professional manner
• Comply with all applicable laws and regulations in their follow-up activities
• Not resell or redistribute leads to third parties without written consent
• Maintain confidentiality of our lead generation methods and processes

6. Data Privacy and Protection

We are committed to protecting the privacy of all data collected through our services. All lead data is:

• Collected in compliance with applicable privacy laws
• Stored securely using industry-standard encryption
• Used solely for the purpose of lead generation services
• Not shared with unauthorized third parties

7. Limitation of Liability

PlasmaRift's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits or business opportunities
• Actions taken by clients based on provided leads
• Third-party claims arising from client's use of leads

8. Service Level Agreements

We commit to:

• Deliver leads within the timeframes specified for each service tier
• Maintain 95% lead accuracy rate
• Provide replacement leads for any that don't meet quality standards
• Offer customer support during business hours (9 AM - 6 PM CST)

9. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination:

• All outstanding invoices become immediately due
• Client retains rights to previously delivered leads
• Confidentiality obligations continue indefinitely
• No refunds will be provided for services already rendered

10. Intellectual Property

All proprietary methods, algorithms, and processes used in our lead generation services remain the exclusive property of PlasmaRift. Clients receive a non-exclusive license to use delivered leads for their business purposes only.

11. Compliance and Legal Requirements

Both parties agree to comply with all applicable laws, including but not limited to:

• CAN-SPAM Act and similar anti-spam regulations
• TCPA (Telephone Consumer Protection Act)
• GDPR and other data protection regulations
• Industry-specific compliance requirements

12. Dispute Resolution

Any disputes arising from this agreement will be resolved through binding arbitration in Texas, USA. The prevailing party is entitled to reasonable attorney fees and costs.

13. Modifications

PlasmaRift reserves the right to modify these terms at any time. Clients will be notified of material changes via email at least 30 days in advance. Continued use of services constitutes acceptance of modified terms.
